As a description, it's both accurate and boring, something that can't be said about having a \"homelab\".<\/p>\n<p>\"A homelab, or simply lab, is a personal space where technology enthusiasts, professionals and hobbyists can experiment with different hardware and software. From virtual machines to your own server, a homelab offers endless possibilities,\" explains Brandon Lee of VirtualizationHowto, one of the many sites publishing tutorials aimed at the burgeoning homelab scene.<\/p>\n<p>David Burgess runs the YouTube channel DB Tech, where he publishes tutorials on technologies related to homelabs and self-hosting in general, such as Docker, Portainer, Proxmox and Pi-Hole, to name but a few. The almost universal common denominator among channels like David's is the absence of piracy, because you can't pirate software that developers gladly give away for free.<\/p>\n<p>Against this backdrop, a new video posted on the channel was immediately disconcerting.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Videos_anciennes_considerees_comme_non_conformes\"><\/span>Older videos considered non-compliant<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>This week, David received a notification from YouTube; unusual because he had disabled notifications two years ago when their frequency became overwhelming. Yet YouTube's communication was important, as it referred to a breach of community guidelines on one of his videos.<\/p>\n<p>Given that David has had a Community Guidelines violation on his account since March 29, 2021, he initially thought the message was about that. But it wasn't.<\/p>\n<p>The background of the first offense is almost history. On March 20, 2020, David uploaded a video to a Docker container for youtube-dl, software that allows people to download videos from YouTube and other platforms. Notably, the upload predates the RIAA's unsuccessful efforts to have youtube-dl removed from GitHub by six months.<\/p>\n<p>While youtube-dl is still available on GitHub today for anyone to download, on March 29, 2021, one year after its initial upload, YouTube informed David that his video on docker\/youtube-dl had been removed for violating YouTube's terms of use. David appealed to YouTube, noting that he had not promoted the tool for copyright infringement, but was eventually told it would not be restored.<\/p>\n<p>No specific reason was given, but YouTube's terms of use state that uploading from the platform is not permitted. Even if YouTube had other issues in mind, the violation of the terms of use cannot be avoided, despite David's history of good behavior.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Decu_de_recevoir_une_infraction\"><\/span>Disappointed to receive an infraction<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>After speaking with David and reviewing his videos, it's clear that YouTube and similar platforms don't focus on people like him when setting the rules. He presents himself well, avoids unreasonable hype and produces clear educational videos that add value to the YouTube platform. Breaching community guidelines is obviously a disappointment for him, beyond simply receiving an infraction.<\/p>\n<p>Given that many other videos remained online when his was removed, including many that openly promoted youtube-dl for copyright infringement, David still feels that the removal was somewhat unfair. As always, the context of the video is important, so while aware of YouTube's rule against uploading, we watched the whole video looking for something egregious.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Aucun_crime_evident_anti-malware_pro-ironie\"><\/span>No obvious crime, anti-malware, pro-irony<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>We found a tutorial video in which David tried to emphasize careful use; certainly not by pirates downloading the latest music videos or people stealing content for their own channels.<\/p>\n<p>The video also devotes time to alternative tools that promise to download YouTube videos, with the main aim of giving users malware. As David explains, for YouTube creators who need to show a snippet of another video in theirs for context, using youtube-dl is a safer option.<\/p>\n<p>Even at this stage, with context arguing in David's favor, uploading videos that aren't already set up to be uploaded is still not allowed by YouTube. The RIAA firmly believes that using youtube-dl to obtain videos from YouTube is a violation of the DMCA, which prohibits the circumvention of digital locks, including YouTube's changing encryption.<\/p>\n<p>Under YouTube's current terms of use, content that \"shows viewers how to gain unauthorized access to content, software or services that typically require payment\" is prohibited under the \"Digital Security Content\" section. This doesn't seem to apply directly to YouTube in this case.<\/p>\n<p>Anti-circumvention and prevention of unauthorized access are key principles in general. This makes the content David uploaded from YouTube, as a demonstration in his now-deleted video, more than just a paradox.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"ArrArrArrAgggh\"><\/span>Arr..Arr..Arr..Agggh<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>On February 5, 2021, David downloaded several tutorial videos on creating the ultimate home media server using Emby, Sonarr, Radarr and Jackett. One of these videos explained how to configure this software, in particular how to make Docker containers communicate with each other; it was a technical network tutorial, nothing more.<\/p>\n<p>This week, David discovered that this specific video (but none of the others) had been removed for violating YouTube's terms of use. Again, dozens of similar tutorials going much further are still online on YouTube, for no immediately obvious reason. David's video was uploaded over three years ago and had accumulated 114,000 views, a figure that will never increase or earn him any more revenue on YouTube.<\/p>\n<p>Some channels specialize in this type of content for obvious reasons, but remain strangely online. David says this creates confusion when trying to assess the interpretation of YouTube's rules and how other videos posted on his channel may be affected.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"De_nouvelles_regles_posent_de_nouvelles_preoccupations\"><\/span>New rules bring new concerns<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>Over the years, YouTube's approach to content has become more restrictive. This isn't usually excessive, but as new rules are put in place, the chances of older content made under different rules finding itself in violation seems to increase. David believes that creators will have to comply with the current rules and then consider how future rules might intervene to make previously acceptable content a violation of the terms of use.<\/p>\n<p>\"Now I have to adopt a very conservative mindset to anticipate what might be misinterpreted by the wrong content moderator as a violation and take corrective action in the future, because, again, who knows when something like this will happen again?\" he says.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Directives_regles_lois\"><\/span>Directives, rules, laws<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>As companies respond to new technologies, the shifting sands of social norms and the effect of government efforts to legislate, regulate and even thwart online behavior, large online platforms like YouTube are forced to change. New rules governing conduct are inevitable, and can often give clues as to how a company hopes to be perceived among its licensing partners and advertisers. As we recently suggested, large-scale personal moderation is already impossible, and new rules bring new problems.<\/p>\n<p>David has no intention of abandoning YouTube, but he seems less inclined to rely on it exclusively in the future.
