Authorities seized the site's main domain names and arrested two alleged Russian operators of the site, who now find themselves at the center of a criminal investigation.<\/p>\n<p>This repressive action shocked millions of Z-Library users, but the underground library eventually recovered and remains online today. This does not mean, however, that the two alleged operators are out of danger.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Les_defendeurs_%C2%AB_confies_a_domicile_%C2%BB_font_face_a_une_extradition\"><\/span>House-bound\" defendants face extradition<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The United States is determined to extradite the defendants so that they can be brought to justice. According to the Department of Justice, the duo played a key role in the operation of the underground library, which ultimately caused significant damage to authors and publishers.<\/p>\n<p>In recent days, several new details have emerged about the extradition efforts. According to court records, both defendants were released from prison in January, after the federal court in Cordoba, Argentina, ruled that \"house arrest\" in a rented apartment was sufficient at this stage.<\/p>\n<p>The same court also examined the extradition request in April and concluded that it was insufficient. The court asked the US authorities to provide more details on the alleged criminal actions and their victims, but the information was never produced.<\/p>\n<p>Instead, extradition was approved a few weeks later, after the Court of Appeal replaced the judge in charge. However, the extradition has not yet been implemented, as an appeal is pending.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"%C2%AB_Non-fugitifs_%C2%BB\"><\/span>\"Non-fugitives<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>In addition to the extradition battle in Argentina, Anton Napolsky and Valeriia Ermakova also answered criminal charges in federal court in New York. The defendants have filed a motion to quash, arguing among other things that the copyright infringement charges are insufficient.<\/p>\n<p>U.S. Attorney Breon Peace opposed the request. In addition to disagreeing on the merits, he argued that the defendants' request should be denied because they are officially fugitives.<\/p>\n<p>\"The defendants are fugitives who have chosen to evade the jurisdiction of this court by remaining in Argentina. Until they submit to U.S. jurisdiction, they have no ability to compel this court to consider the present motion - or any other type of motion,\" Peace wrote.<\/p>\n<p>This week, the defendants responded with a different view of the situation. According to their lawyers, the term fugitive does not apply here.<\/p>\n<p>A traditional fugitive is someone who flees jurisdiction after committing a crime to escape justice. In this case, the defendants were tourists in Argentina; they didn't go there to escape justice.<\/p>\n<p>\"The defendants were at no time in the United States in connection with the indictment and have never resided in that country. Contrary to the government's insinuations, at the time of their arrest, they were not hiding in a remote region of Argentina, but were traveling as tourists.<\/p>\n<p>\"The defendants are Russian nationals. If they had wanted to hide from justice, they would have stayed in their native Russia, a country with no extradition treaty with the United States,\" the lawyers add.<\/p>\n<p>Fugitive status is important in this case, as people fleeing a jurisdiction may not be able to file a motion to quash. The defense argues that this argument should not apply here.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Aucun_serveur_americain\"><\/span>No U.S. server<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>With regard to the copyright infringement charges, the defense points out that there is no evidence that Napolsky and Ermakova used U.S.-based servers to store copyrighted works. Nor did they own servers in the USA.<\/p>\n<p>\"There is not a single allegation in the Amending Indictment or the Complaint that Defendants used servers located in the United States to store infringing copies of copyrighted materials,\" the attorneys write.<\/p>\n<p>The defendants used Gmail and Amazon to collect donations. However, the defense points out that these companies had also previously operated in Russia and that their use of these services is not sufficient to establish jurisdiction.<\/p>\n<p>If this logic were applied, people could be subject to the jurisdiction of a Chinese court if they appeal Zoom, the lawyers note.<\/p>\n<p>\"Defendants' simple use of Gmail or purchase on Russian Amazon is not sufficient to establish domestic activity in the United States. For example, Zoom has data centers in China, and some U.S. calls were previously handled via a Chinese server.<\/p>\n<p>\"To consider a domestic activity on the basis of an involuntary transmission to servers in another country by third-party Internet service providers would mean that a person is engaged in a domestic activity in China when they make that Zoom call.\"<\/p>\n<p>The defense asserts that anyone using the Internet will automatically have their traffic routed across multiple countries. To establish jurisdiction, more substantial claims based on Gmail and Amazon would be required, it argues.<\/p>\n<h2><span class=\"ez-toc-section\" id=\"Quest-ce_qui_fonctionne\"><\/span>What works?<span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p>The Public Prosecutor's Office also points out that the indictment does not list any copyrighted works that the Z-Library defendants have allegedly infringed. In other words, no specific pirated works are mentioned. This is another shortcoming that justifies dismissal.<\/p>\n<p>The government argues that it is not obliged to detail concrete offences at this stage, but this conclusion is erroneous, according to defense lawyers.<\/p>\n<p>On the basis of these and other arguments, Napolsky and Ermakova are asking the New York federal court to dismiss the amended indictment.
